Terms of Service

Welcome to TraceErase, a trading name of R2D2S TECH LIMITED. Please read this information carefully. The TraceErase Terms of Service ('Terms of Service') govern Your access to and use of the TraceErase Service (as defined below) available through the website www.traceerase.co.uk and mobile applications ('Website') and the use of and access to the Website. These Terms of Service are a binding legal agreement between R2D2S TECH LIMITED ('TraceErase', 'We', 'Us', 'Our') and You ('You', 'Your'). You agree and accept to be bound by these Terms of Service by either: (i) creating an account to use the Service; (ii) accessing/using the Service (as defined below) and/or Website.

OUR SERVICE AND/OR WEBSITE IS OFFERED TO YOU ON THE CONDITION OF YOUR ACCEPTANCE OF THESE TERMS OF SERVICE. PLEASE READ ALL OF THEM CAREFULLY. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS OR ANY PROVISIONS HEREOF, PLEASE DO NOT ACCESS AND USE OUR SERVICE AND/OR WEBSITE.

What is TraceErase?

TraceErase acts on Your behalf to contact data brokers requesting the implementation of Your privacy rights, specifically by asking those organisations to stop using Your details for direct marketing and to erase personal information they hold about You where the right to erasure applies, for the organisations and actions named in Your written authority. ('Removal Requests') ('TraceErase Service' or 'Service'). When mentioning data brokers We refer to entities which collect, analyse, and/or sell Your personal information (usually in high volumes) to third parties or use it themselves for profit (often without Your informed consent). For this, You will need to provide Us with the personal information needed for each request: for the broker clean-up service, Your name and the email address or addresses You used and, if You choose, a phone number or postcode, so that We can prepare the Removal Requests. You give Us a written authority (the 'Authorisation Form'), which You confirm in Your account. It names the organisations and the actions it covers, the date it ends and the version of its wording. It is necessary to contact organisations on Your behalf, and You can withdraw it at any time. We may need You to provide Us with some documents necessary to prove Your identity, proof that You have authorised Us to act on Your behalf, or any other information required for the provision of the TraceErase Service. Where an organisation needs sensitive identity evidence, We will say so and You may be asked to send it to that organisation directly.

TraceErase provides a monthly or annual subscription that includes email breach checks and eligible privacy requests handled on your behalf.

TraceErase offers email breach checks using Have I Been Pwned. By maintaining your subscription, you can run a breach check on the email address on Your account whenever You ask. Eligible subscribers can choose scheduled checks of their confirmed account email and separately choose email alerts. Each choice is off until You turn it on, You can turn either off at any time, and both need an active subscription. Checks run periodically rather than continuously. A newly listed breach may relate to an older incident. A check only covers breaches that Have I Been Pwned has listed, and a check that could not run is not a clear result. Results do not establish whether your information has been misused.

We will also continue to submit and manage supported data removal requests on your behalf within the scope of Your written authority, including recording replies. Follow-ups are not currently switched on. If you choose to cancel your subscription while a data removal request is still in progress or awaiting a response, responsibility for any further follow up will transfer to you as the customer. TraceErase accepts no liability for any incomplete or unresolved removals resulting from a cancelled subscription.

Once TraceErase has contacted an organisation to make a request on your behalf, the time the organisation has to respond is set by the law that applies, not by TraceErase. In most cases this is one calendar month under UK GDPR, although this period may be extended for more complex requests where permitted. TraceErase works out an indicative response date from the date it sent the request; it is a guide that needs confirming, not legal advice. Provided your TraceErase subscription remains active, we will keep recording replies to your supported requests until a response is received or the request is resolved. Follow-ups are not currently switched on. A response does not mean the request has been fully carried out; We record what the organisation tells Us and the scope it covers.

Information about the organisations We cover, and to whom We send the Removal Requests on your behalf, is available on the Coverage page. Please be informed that the list of covered organisations is subject to change, and that an organisation being listed does not mean that We have found an account or data of Yours there. A Removal Request being sent, or an organisation replying, does not mean that any data has been erased or any marketing stopped; We record what the organisation tells Us. Subscribing does not give Us permission to contact anyone. We send a request only to an organisation You have named in the written authority You confirm in Your account, for the actions it covers, and only after You have approved the exact wording of the request and Our team has approved it. If Our team changes the wording after You have approved it, You are asked to approve the changed wording again. Website help is an assessment by Our team: nothing is sent to a website unless a supported request is approved.

Availability: the description above is the service TraceErase is built to provide. Whether managed request delivery is open to Your account at any time is shown in the product. Nothing is sent to any organisation on Your behalf unless You have given Your written permission and the exact request has been approved, and a limited number of requests are sent each day. Where managed handling is not available for an organisation, the product says so and shows what You can do yourself.

You will need to create an account

To use the TraceErase Service, You will need to set up your personal account and subscribe to TraceErase. You are solely responsible for all usage of, or activity on, Your account including, but not limited to, use of the account by any person who uses Your account with or without authorisation, or who has access to any device on which Your account resides or is accessible.

To set up an account, You will need to complete the registration process by providing complete and accurate information about Yourself which is detailed within the registration form. You will be asked to provide an email address and password. You are entirely responsible for maintaining the confidentiality of Your password. You may not sell or trade that account to any other person. Also, you cannot change the sign-up email address.

You agree to notify Us immediately of any unauthorised use of Your account, email address or password. We are not liable for any loss that You or any third party incur as a result of any unauthorised use of your account, either with or without Your knowledge. We reserve the right to terminate Your account at any time.

You are responsible for providing correct information. Nevertheless, You have the option to update the information (except the sign-up email) You provide to Us at any time. Once You create an account and provide the required information to Us, such information will be used to automatically draft the authorisation form. Please be aware that any changes You make to the required information will take effect after a specific period of time, which varies depending on the data broker involved.

Last but not least, TraceErase is intended solely for personal use and, as such, You are permitted to create only one account.

Change of the Subscription Plan

If You purchased Your subscription via Website, You may upgrade and downgrade Your subscription plan at any time, and the upgrade/ downgrade will be effective immediately. Conversely, downgrades can be made at any time and will take effect on your next billing cycle. However, upgrades and downgrades may be limited to certain subscription plans depending on your current plan.

Payment, Automatic Renewal and Refund Terms

TraceErase Service is provided by subscription only. To start getting the Service You will need to subscribe to TraceErase. You choose the subscription and the payment method from the available options at the time of purchase.

The TraceErase Service renews automatically at the end of each service period and Your chosen payment method is charged again, unless You decide to cancel your automatic payments before the automatic renewal date. If You prefer to cancel the automatic renewal, you can do so directly in your personal account in Your profile or you can contact customer support. When you cancel the automatic renewal, you cancel only future charges associated with TraceErase Service subscription and you will continue to receive access to the Services until the end of the then-current subscription period.

Please note that by entering Your payment details You agree to the automatic renewal. If you do not cancel the automatic renewal of the Service, your Service subscription will be renewed automatically, and you will be charged with a chosen payment method.

TraceErase may change the price for the subscriptions, including recurring subscription fees, or other subscription terms from time to time and will communicate the new price or other changes to You in advance. Subject to applicable law, You accept the new price and terms by continuing to use the Service after the changes take effect.

Prior to the conclusion of your current subscription period, we may initiate a pre-authorisation transaction on the payment card provided. A nominal amount may be temporarily charged to validate your payment method's status. Upon successful verification, this amount will be promptly reversed and will not reflect as a permanent transaction on your account. This practice helps ensure uninterrupted access to the Service and confirms the ongoing validity of your payment method for future billing cycles.

Refunds are provided in accordance with applicable UK consumer law. If you purchase or renew a subscription, you may be entitled to a refund where required by law. Where a refund is due, this may be provided in full or on a pro rata basis, depending on the circumstances and the remaining unused portion of the service.

You have the right to delete your account at any time. However, deleting your account does not automatically entitle you to a refund for any unused part of an active subscription. A request to delete your account does not count as a refund request. If you believe you are entitled to a refund under UK law, you must contact our support team separately.

No refunds will be issued where an account has been terminated due to a breach of our Terms of Service, except where required by law.

All payments are processed securely through Stripe, our third party payment provider. If you are charged in a currency different from your bank account or card currency, your bank or card provider may apply currency conversion fees. We are not responsible for any additional charges or fees applied by your bank or card provider. Any refunds will be issued to the original payment method used at the time of purchase.
